TERMS AND CONDITIONS PCB LOGISTICS INC
(“PCB LOGISTICS INC”) is a fully licensed and bonded auto transport broker with the U.S. Department of Transportation (USDOT broker license #3828706, MC# 1388075). These Auto SHIPPING Service – Terms and Conditions (the “Agreement”) govern the Services (as defined in this Agreement) provided by PCB LOGISTICS INC to you, as the client (“you” or designated person(s) appointed by you, referred to herein as “Client”).
pcbautoshipping.com is fully owned by PCB LOGISTICS INC. and also the DBA of PCB LOGISTICS INC.
By signing this paperwork, the Customer confirms that he/she is working with ONLY ONE broker company and also allowed us post the vehicle on the national load board called Central Dispatch. The Customer agrees not to contact any other broker or carrier until the vehicle is delivered. Any Customer found working with another company regarding the transportation of the same vehicle is subject to non-refundable deposit or price changes.
In providing the Services, PCB LOGISTICS INC is acting solely in the capacity of an auto transport broker to connect you with a Carrier for the purposes of moving your Vehicle. PCB LOGISTICS INC is not responsible for moving your Vehicle nor will PCB LOGISTICS INC take possession of your Vehicle. PCB LOGISTICS INC will identify and contract with a transport car carrier (“Carrier”) to transport your Vehicle (as defined in this Agreement) in accordance with your order (the “Services”). PCB LOGISTICS INC’s Services are considered rendered when PCB LOGISTICS INC has designated a Carrier to transport your vehicle.
You agree to pay in full the fees for Services and any additional charges that may be incurred in accordance with this Agreement. The Payment must be paid by credit/debit card, PayPal, Zelle, Cashapp. By booking an order, you authorize PCB LOGISTICS INC to immediately charge the Payment. The fees for the Services will be set forth in the agreement (contract) sent to you by PCB LOGISTICS INC via verification email. Please note that the quoted price is an estimate generated by our system from various load boards for your route which may change due to uncontrollable circumstances. The Remaining Balance and any additional charges incurred in accordance with this Agreement must be paid in full by cash, money order, or certified check, directly to the Carrier upon delivery of your Vehicle. Failure to remit the Remaining Balance when due will result in the storage of the Vehicle at your expense until the balance is paid in full. All amounts due must be paid in full when due and the fees are not subject to dispute or offset for any damages or any other reason (including, without limitation, because you are not satisfied with the Services). Once paid, charges are non-refundable. Failure to timely provide payment may result in a delay in designating a Carrier to transport your Vehicle and/or delivery of your Vehicle. In addition, if you fail to make any payment when due or we receive a chargeback for your payment (whether due to a dispute of the charge or any other reason), then you must pay PCB LOGISTICS INC the outstanding amount owed plus reimbursement for all reasonable costs incurred in collecting any overdue payment or chargeback and related interest, including, without limitation, attorneys’ fees, legal costs, court costs, and collection agency fees. All late payments and chargebacks will be charged interest, calculated from the date the payment was originally due, at a rate of 1% per month or the highest rate permissible under applicable Law.
You may change your order at any time prior to your Vehicle is assigned to Carrier designated by PCB LOGISTICS INC. Order changes may result in additional fees. If the additional fees are not agreed upon, the order will be cancelled. If you cancel your order before a Carrier has been designated to transport your Vehicle, you will be charged a non-refundable processing fee of $200 per vehicle, please note this also applies if the customer cancels the shipment before the pickup date. If you cancel your order after a Carrier has been designated to transport your Vehicle, you will be charged a cancellation fee in the amount of full Payment (100% of the total SHIPPING cost), as our services have been rendered. Our cancellation fee is implemented to compensate for the loss of truck space, fuel, and “dead” mileage driven. Orders cannot be cancelled or changed after the Vehicle has been picked up. All order change and cancellation requests must be submitted in writing to contact@pcblogisticsinc.com. All cancellations must be via email to our branch prior to the assignment of your vehicle/shipment to a carrier.
The PCB LOGISTICS INC shall provide Customer with an estimated pick up and estimated delivery date. However, delays may occur prior to, and/or during transport due to weather, road conditions, carrier mechanical problems, etc. There are absolutely no guarantees regarding pick-up or delivery times and dates. Broker shall not be held responsible for loss or damages occasioned by delays of any kind or for any reason, car rental fees, or any
accommodation fees. Broker shall not be held liable for the failure of mechanical or operating parts of your vehicle. The Broker has 30 business days in order to find the Carrier. If the Customer wants to terminate the contract before the 10 business days expire, the Customer may be responsible for a Cancellation Fee of $200.
The Customer must prepare vehicle for transport. All loose parts, fragile accessories, low-hanging spoilers, etc. must be removed or secured. Shipper shall remove all non-permanent outside mounted luggage, bike racks, and other racks prior to shipment. Vehicles must be tendered to carriers in good running condition (unless otherwise noted). Any part of the vehicle that falls off during transport is the Customers responsibility including damages caused by said part to any vehicle(s) and/or person involved.
Luggage and personal property must be confined in trunk only, with no heavy articles, and not to exceed 100 lbs. Broker or Carrier is not liable for personal items left in the vehicle, nor for damage caused to vehicle from excessive or improper loading of personal items. No personal property shall be transported in the customer’s vehicle(s) that includes but is not limited to Explosives, Guns, Ammunition, Flammable Products, Narcotics, Negotiable and Legal Papers, Alcoholic Beverages, Jewellery, Furs, Money, Live Pets, Live Plants, or any unlawful contraband. The customer agrees that PCB LOGISTICS INC may confiscate or dispose of said items with no remuneration. Broker or Driver will not be held responsible for the delivery of personal property. If the Customer wishes to put items in the vehicle he does so at his own risk.
If the vehicle is inoperable or oversize (dual or oversize wheels, extra-large, racks, lifted, limo, etc.), the inoperable fee is $200.00. Customers must inquire as to extra charges for lifted or modified vehicles. If the Broker is not advised of inoperable or oversized/modified vehicles prior to pick-up, there can be additional charges. If the assigned carrier is unable to load due to size issues, a no-load fee up to $1,000.00 can be charged at the broker’s discretion.
On pick up, the Customer and Carrier will carefully inspect the vehicle for pre-existing damage (exterior only) by completing a vehicle inspection report. The Carrier and Customer will both acknowledge the condition of the vehicle and the Customer will sign and receive a copy of the bill of lading. At the time of delivery, the Customer and Carrier will carefully inspect the vehicle for transportation damages. The Carrier and Customer will both acknowledge the condition of the vehicle and the Customer will sign and receive a final copy of the bill of lading. From the time of pick up, until delivery, the Customer agrees to carry their own full coverage insurance on vehicle from the time of pick up until delivery, in the event, the carrier’s insurance denies coverage for loss or damage, the customer shall file a claim with their own insurance and not hold Broker liable.
In any event, the Broker will not be responsible for ANY damage or loss to you, involved parties, or the vehicle during transport. The Carrier actually Transporting the vehicle shall be liable for any and all damage arising from the transport. Shipper agrees to file all claims with the carrier as identified on the bill of lading/vehicle inspection report and bring any legal action for damage against carrier ONLY. Shipper agrees to release and hold Broker harmless of ANY such loss or claims. Limitations of Broker liability in connection with the vehicle is limited to the lesser of your actual damage or actual cash value of the vehicle or $50,000. All damage must be noted in the proper place on the Carriers Bill of lading and signed by the Customer, regardless of whether or time of day. Signing the Carriers bill of lading or inspection report without notation of any damage verifies that the Customer has received vehicle(s) in satisfactory condition. All claims must be submitted in writing to Broker and/or Carrier within 24 hours of delivery. The broker will share the carrier insurance policy upon request. Department of Transportation regulations requires that all claims are filed in writing and all tariffs are paid in full before a claim can be processed. If for any reason the Carriers insurance denies coverage, the Customer will file a claim for damages or loss with their own insurance and not hold the Broker liable.
IF YOU DO NOT AGREE TO ALL OF THE TERMS AND CONDITIONS OF THIS CONTRACT, YOU SHALL NOT USE THE SERVICES.
